New changes to the Mass. Homestead Act to take effect this week (March 16)
We just wanted to remind you that changes to the Massachusetts Homestead Act will take effect this Wednesday, March 16. If you don’t already know, the Homestead Act (actually, the exact term is “Declaration of Estate of Homestead) is a legal document filed at the registry of deeds that informs the public that the homeowner is asserting his/her rights to protect the equity in the home from subsequent creditors.
However, as you can imagine there is a little more to it. Here are couple of resources you might find helpful:
- “What changes in the Massachusetts Homestead Law means to homeowners” by MAR Associate General Counsel, Michael McDonagh; and
- “Beginning this week, Homestead Act strengthens protection” by Stephanie Ebbert, Boston Globe
Just remember, with many issues, homeowners should consult their personal attorney regarding specific legal questions about the Homestead Act and how they may or may not be impacted by the new changes.

Big month to month increase in Mass. February REALTOR (R) Market Index
Today we issued the results of the February 2011 REALTOR(R) Market Index (RMI) and the REALTOR(R) Price Index (RPI). The February RMI was up 32 percent from the January RMI, for the largest month-to-month increase since survey data has been collected. The RPI was essentially flat (up 0.64%) from January while both the RMI and RPI were down from the year before.
This month’s “Hot Topic” question asked REALTOR(R) member about their client’s ability to secure financing in the current lending environment compared to last year.

- REALTOR® Market Index was 28.06. Up 32% from January
- REALTOR® Market Index was down 32% from same time last year
- REALTOR® Price Index was 46.96. Up 0.64 from January
